WEST VIRGINIA ABOVEGROUND STORAGE TANK ACT

Larson Design Group (LDG) wants to remind owners of aboveground storage tanks about the July 1 registration deadline.  All tanks must be registered through the West Virginia Department of Environmental Protection to avoid being subject to possible enforcement action.

Senate Bill 423 went into effect on June 12, 2015, amending the Aboveground Storage Tank and Public Water Supply Protection Acts.  Among the changes is a new definition of what is considered an aboveground storage tank (AST).  Don’t worry, we are here to help you with tank registrations and keep you in compliance now and into the future.

WEST VIRGINIA DEP AMENDED ABOVEGROUND STORAGE TANK ACT:  REGULATORY REQUIREMENTS AND DEADLINES EFFECTIVE JUNE 12, 2015

  • Open Registration – Operations & non-operational ASTs (see definition) must be registered by July 1, 2015.
  • WVDEP will determine the operating and permitting requirements, as well as the submittal deadline for each registered tank (some facilities will be exempt from permits as per the act).
  • Spill Prevention Response Plan submittals are due December 9, 2015.  Approved plans sumbitted to County and Municipal EMAs.

 

Definition:  Aboveground storage tank or tank or AST means a device made to contain an accumulation of more  than 1,320 gallons of fluids that are liquid at standard temperature and pressure, which is constructed primarily of nonearthen materials, including concrete, steel, plastic or fiberglass reinforced plastic, which provide structural support, more than 90% of the  capacity of which is above the surface of the ground, and includes all ancillary pipes and dispensing systems up to the 1st point of isolation. The term includes stationary devices which are permanently affixed, and mobile devices which remain in 1 location on a continuous basis for 365 or more days.  The following tank categories are not subject to the Aboveground Storage Tank Act:  Shipping containers, barges or boats, swimming pools, process vessels, fresh water holding tanks, tanks containing food or food-grade materials, and empty tanks held in inventory or for sale.
